1. Introduction
These Terms and Conditions (“Terms”) govern the use of home health services provided by Guardian Care Plus (“Company”, “we”, “our”, or “us”) to the client (“Customer”, “you”, or “your”). By availing our services, you agree to comply with and be bound by these Terms.
2. Scope of Services
Our services may include but are not limited to:
- Home nursing care
- Patient caregiving and attendant services
- Physiotherapy and rehabilitation
- Medical equipment rental and delivery
- Doctor visits and other allied health support
The scope and duration of services will be specified in your service plan or agreement.
3. Service Timings and Scheduling
- Service timings will be mutually agreed upon and confirmed in advance.
- Any changes in schedule must be informed at least 24 hours prior.
- The company reserves the right to reschedule due to staff availability, emergencies, or unforeseen circumstances.
4. Payments and Charges
- All payments must be made in advance unless otherwise agreed in writing.
- Charges are based on the selected service package, duration, and location.
- Delayed payments may lead to service suspension or termination.
- Taxes and additional fees (if applicable) will be added to the final bill.
5. Cancellations and Refunds
- Cancellations made at least 24 hours before service commencement are eligible for partial or full refund (as per company policy).
- No refunds will be provided for cancellations after service initiation.
- In case of equipment rentals, refunds (if any) will be processed only after inspection and return of the equipment in good condition.
6. Staff Conduct and Replacement
- All staff are trained and background-verified professionals.
- If the customer is dissatisfied with staff performance or behavior, a replacement can be requested.
- Customers are requested not to assign tasks outside the defined service scope.
7. Customer Responsibilities
- Provide a safe, respectful, and hygienic working environment.
- Refrain from personal, inappropriate, or abusive behavior towards staff.
- Ensure timely availability of necessary supplies (if applicable).
- The customer or family member should be present during service initiation and closing.
8. Liability and Disclaimer
- The company shall not be liable for any pre-existing medical conditions, unforeseen complications, or events beyond reasonable control.
- While every effort is made to ensure high-quality care, outcomes may vary based on patient condition.
- The company is not responsible for loss, theft, or damage of personal belongings.
9. Equipment Use (if applicable)
- Rented equipment must be used as instructed and returned in the same condition.
- Any damage or loss during the rental period will be charged to the customer.
- The company reserves the right to inspect or replace equipment during the rental period.
10. Confidentiality
All personal, medical, and contact details shared with the company are strictly confidential and will only be used for service-related purposes.
11. Termination of Service
- The company reserves the right to terminate services immediately in case of:
- Non-payment or repeated payment delays
- Misconduct, abuse, or unsafe working conditions
- Violation of these Terms and Conditions
12. Governing Law and Jurisdiction
These Terms are governed by the laws of India. Any disputes shall be subject to the jurisdiction of courts within India.
